Terms of Services - Gordon Digital Marketing

Introduction

These general and specific terms of hosting services govern the legal relationship between Gordon DM (hereinafter referred to as the Service Provider) and the service user. The general terms of use came into effect on 10.02.2020 and remain valid until modified. We may update or amend these terms from time to time to comply with legal requirements or adapt to changing business needs.

Prices and Payment Terms

The price list for all services provided by the Service Provider is publicly available under the “Services – Gordon Digital Marketing” section on the website, in the tabs corresponding to the services you’re interested in.

Gordon Digital Marketing is authorized to change the price list, and users will be notified of any changes through a publication on their website or by other appropriate means.

The revised price will apply to existing users 30 days after the changes are published on the official Gordon Digital Marketing website or through another appropriate means.

The user agrees to pay for the services by the due date. In case the invoice is not settled by the due date, Gordon DM is authorized to charge statutory default interest on overdue, unpaid claims, as well as the costs of sending reminders, and has the right to deactivate the service to prevent further damage to the client.

If the user fails to settle their obligations to Gordon DM within 30 days from the date of the pro forma/invoice, after a written reminder, Gordon DM may immediately terminate the user relationship without further written notice and initiate legal collection proceedings.

Confidential Information

Gordon DM respects the privacy of its clients and will only use the information provided by the client in mutual communication. Some of this private data is crucial for the registration of hosting and domains, and will be used for these purposes. We will use private data to fulfill individual requests for information and rely on this data to better understand the needs of users, in order to improve our products and services. In this regard, we may use this information to contact users. We will not sell or use this data, nor will we share it with any third party without the user’s consent.

Transparency of Information

The user is required to provide full access to their web space if necessary in the case of a legal dispute, prosecution, or investigation conducted against the user. Gordon DM has no grounds to provide or grant access credentials to any third party, as the user has full administrative rights to manage their domain and the entire administration of their web space. In the case of an investigation by authorized domestic or foreign government institutions, legal disputes, or lawsuits, based on an official court order or police investigation, Gordon DM is permitted to grant access to information about the user account, the initial order offer, and the official invoice issued to the User.

Prohibition of Reselling Hosting Services

Hosting packages are strictly for the user’s use. Users of hosting packages are not authorized to resell the purchased package or provide hosting services to third parties on the purchased space unless an agreement is made with Gordon DM.

Any severe violation of this rule will result in the immediate termination of the service without prior notice. Gordon DM is not liable for any damages or claims that may arise from the user’s failure to comply with these rules. The user agrees to compensate Gordon DM for any costs incurred by third parties due to inappropriate use of the services.

Warnings Prior to Service Expiration, Suspension, and Deletion

Gordon DM will notify the user via email, SMS, or other suitable methods 30 days prior to the service expiration, and will send the user a proforma invoice for the service renewal.

If the payment is completed, the user will receive the original invoice via mail.

In case of severe violation of the rules, Gordon DM has the right to deactivate the service without prior warning.

The client is obligated to inform Gordon DM of any changes to personal data (name, address, phone number). Gordon DM is not responsible if the user does not receive a notice, proforma invoice, or final invoice due to incorrect data provided.

Client Behavior

Under no circumstances will threatening or violent behavior towards Gordon DM employees be tolerated. If such behavior occurs, we reserve the right to immediately terminate the hosting agreement.

If a client, during a phone call, email, or any other form of communication, indicates the intention to take legal action against Gordon DM or makes any statements that could be interpreted as such, we reserve the right to refuse telephone support. Any further correspondence must then be sent via email.
